PROBATE

Probate is the legal process through which property is transferred after a property owner's death.  It is the gathering of all assets, the payment or settling of debts, and method by which assets are distributed to the heirs of a deceased person.  Behar Law P.A. regularly represents clients in both the administration of estates, as well as in any litigation which may arise in such proceedings.  This includes will contests, defending and prosecuting actions against personal representatives/executors, will reformation and construction actions, and creditor claim issues, among others.

TRUST LAW

A trust is a legal relationship created at the direction of one or more individuals in which property is held subject to certain duties to use and protect the assets for the benefit of themselves or others.  These duties can come from the language of the trust itself or from legal requirements found in statute and caselaw.  Behar Law P.A. represents beneficiaries and fiduciaries in both the administration of trusts, as well as in trust litigation, including trust contests, actions against trustees, fee disputes, accounting actions, and reformation and construction actions.

GUARDIANSHIP

A guardian is a person who is lawfully invested with the power and obligation of taking care of and managing the property and rights of a person who is incapable of handling his or her own affairs.  Behar Law P.A. represents clients at all stages of the guardianship process, including determinations of incapacity, litigation concerning advance directives and alternatives to guardianship, as well as in the administration of the guardianship itself.  Litigation concerning guardianships touches on the most sensitive interests and requires specialized knowledge of the duties and requirements imposed on guardians under Florida law.  Jacobeli J. Behar has represented clients in plenary, limited, minor, and voluntary guardianships, and can advise clients as to their rights and responsibilities under each form of guardianship. 

ESTATE PLANNING & ADVANCE DIRECTIVES

Estate planning is the process by which individuals can best prepare for the future, protect their assets, and ensure that their wishes are respected in the event of incapacity or death.  Behar Law P.A. offer estate planning services to clients which include the preparation of wills, trusts, living wills, pre-need guardian designations, powers of attorney, and health-care surrogate designations.  These documents are critical in order to preserve your hard earned legacy and to provide a plan for your family should you be unable to manage your own affairs.  Estate planning and advance directives can also provide the key advantage of avoiding probate through the courts, protecting your privacy, and preventing litigation.

COMMERCIAL & CIVIL LITIGATION

Disputes often arise in the transaction of business which require civil action.  Behar Law P.A. assists clients in pursuing and defending business and contract claims between individuals and corporations or between corporations.  Litigation over such disputes often relies upon detailed discovery practices, including depositions, subpoenas, document requests, and investigation.  Such preparation often leads to settlement, but in the event of trial Behar Law P.A. is prepared to pursue all available remedies resulting from your claim.

APPEALS

Jacobeli J. Behar has filed appeals and argued before the Third District Court of Appeal of Florida.  Behar Law P.A. is prepared to review and evaluate your appellate matter, particularly in the areas of probate, trust, and guardianship law.  These highly specialized cases often present matters of first impression to our appellate courts and require knowledge and experience in order to make persuasive arguments that could result in binding precedent and the affirmation or reversal of trial court orders.
